Terms of Service

These Terms of Service (“Terms”) govern your use of the RentalToolService.com website and your rental of equipment through our platform. By creating an account, making a booking, or using our services, you agree to these Terms in full. If you do not agree, do not use our services.
1. Eligibility
You must be at least 18 years of age to create an account or make a booking. By using our services, you represent that you are of legal age and have the legal authority to enter into a binding agreement. If you are booking on behalf of a company or organisation, you represent that you have the authority to bind that entity to these Terms.
2. Equipment Rental Agreement
When you complete a booking, a rental agreement is formed between you (the “Renter”) and RentalToolService.com. The equipment is made available for your exclusive use during the agreed rental period for the purpose stated in your booking. Equipment must not be subleased, lent, or otherwise made available to third parties without our prior written consent.
The rental period begins at the confirmed start time — either upon delivery to your nominated site or upon collection from our depot — and ends at the agreed return time. Extensions to the rental period must be requested at least four hours before the scheduled end time and are subject to availability. Late returns will be charged at the applicable daily or hourly rate for each additional period or part thereof.
3. Your Responsibilities
You are responsible for operating all rented equipment safely and in accordance with the manufacturer’s operating manual, relevant workplace health and safety legislation, and any site-specific requirements. It is your responsibility to ensure that all operators hold any licences, certifications, or tickets required by law to operate the equipment in your jurisdiction.
You must inspect the equipment at the time of delivery or collection and report any pre-existing damage, faults, or missing components to us within two hours. Failure to report damage within this window may result in you being held responsible for pre-existing conditions.
You must not modify, dismantle, or attempt to repair the equipment. If the equipment develops a fault during the rental period, stop operation and contact us at support@rentaltoolservice.com immediately. Continued operation of faulty equipment that leads to further damage is your responsibility.
Equipment must be returned in the same condition it was delivered, allowing for normal wear and tear. This includes returning with the same fuel level (for diesel equipment) unless we have agreed to a full-to-full arrangement in writing.
4. Prohibited Uses
Equipment must not be used for any purpose that is illegal, unsafe, or contrary to the operating specifications set out in the listing or operator manual. Prohibited uses include but are not limited to: operating beyond rated load or reach capacities; using lifting equipment without a spotter or banksman where required; operating on ground conditions that are unsuitable for the equipment’s weight and footprint; and using equipment in conditions (weather, confined spaces, hazardous environments) for which it is not rated.
5. Damage, Loss, and Liability
You are liable for any damage to the equipment during the rental period that exceeds normal wear and tear, including damage caused by misuse, overloading, accidents, theft, fire, vandalism, or operating in prohibited conditions. Damage costs are assessed by our service team and charged at repair cost plus a reasonable downtime fee for periods the unit is unavailable for rent due to repairs.
In the event of theft or total loss of equipment, you are liable for the replacement value of the unit as listed in our current fleet valuation. You are strongly advised to ensure your own public liability and equipment insurance covers third-party plant hire.
RentalToolService.com is not liable for indirect, consequential, or economic loss arising from equipment breakdown, late delivery, or equipment unavailability, including but not limited to project delays, missed deadlines, or consequential costs. Our liability is limited to the value of the rental transaction in question.
6. Payments and Pricing
All prices on the website are quoted in Australian Dollars and are inclusive of GST unless otherwise stated. Payment is collected in full at the time of booking for rental periods under 14 days. For longer-term rentals or approved business accounts, invoicing terms of 14 days net apply. We accept Visa, Mastercard, and American Express. Declined payments will result in automatic booking cancellation.
7. Cancellations
Cancellations are subject to our Refund Policy, available at rentaltoolservice.com/refund-policy. Cancellations must be submitted in writing to support@rentaltoolservice.com or through your account dashboard.
8. Intellectual Property
All content on the RentalToolService.com website, including text, images, logos, and software, is owned by or licensed to RentalToolService.com and is protected by copyright. You may not reproduce, republish, or distribute any content without our prior written permission.
9. Governing Law
These Terms are governed by the laws of Australia. Any dispute arising from these Terms or your use of our services is subject to the exclusive jurisdiction of the courts of Australia.
10. Changes to These Terms
We may update these Terms at any time. The current version will always be published at rentaltoolservice.com/terms-of-service with the updated date. Continued use of our services after changes take effect constitutes acceptance of the revised Terms.
